Ohio Senate approves bill with changes to legal recreational marijuana

COLUMBUS, Ohio (WTVG) – Ohio Gov. Mike DeWine is urging lawmakers to pass a bill with a series of revisions to the new legal recreational marijuana law in Ohio. It comes as Issue 2, passed by voters last month, is set to take effect Thursday, Dec. 7.

The Ohio Senate passed a measure in a 28-2 vote Wednesday that will still need to be cleared by the House before any of the changes could take effect, so Issue 2 will be implemented Thursday as originally written. As of Dec. 7, adults in Ohio will be able to possess 2.5 ounces of marijuana and grow it at home.

Under the bill the state senate passed Wednesday, medical dispensaries would be able to sell recreational marijuana as soon as the bill would take effect, dramatically speeding up the timeline for when adults could buy recreational marijuana in the state. DeWine said Wednesday that move is in the interest of limiting black market purchases and maximizing the tax benefits for the state.

The bill would also limit the number of plants Ohioans can grow at home to six plants, as opposed to the 12 plants allowed under the measure voters approved in November. There are also provisions on a permissible amount of THC in flower and extracts. Other amendments include taxing marijuana sales at 15% and even creating a process to expunge marijuana possession charges.

The version of the bill that passed comes after a series of concessions from the provisions Ohio Republicans initially proposed earlier this week.

The House would still need to approve the bill before it can head to DeWine’s desk for approval.
