Nearly 70-percent of voters who turned out for Tuesday’s primary election in Toledo were in favor of decriminalizing marijuana.
The passing of Issue 1 eliminates jail time and fines for some marijuana offenses – but not all.
With the issue’s passage, anyone caught with up to 200 grams of marijuana will not face jail time.
Former Toledo City Council candidate Sean Nestor was behind the effort to get the pot issue passed. He says the new ordinance will free up time for courts, in addition to protecting reputations for non-violent marijuana offenders.
However, the passage of Issue 1 does not make it legal to use marijuana in public. "It means that Toledo Police will have to lower the priorities on marijuana infractions," said Nestor.
Possession of the drug remains illegal at the state and federal level, meaning if someone is found with the drug by a state trooper or federal agent, that person could face jail time.
Toledo’s new, relaxed marijuana enforcement will not take effect immediately. Results from Tuesday’s vote must first be certified by the Lucas County Board of Elections.
The enforcement is expected to take effect on Oct. 5, according to the elections board.
Meanwhile, at the state level, the Ohio Supreme Court has ordered that wording for Issue 3 – a proposal to legalize marijuana – is misleading and must be rewritten prior to being placed on the November ballot.
