The Pea Ridge, Arkansas school district has come under fire for denying three siblings the right to attend school based on speculation that they may be HIV-positive. The school found in its records that the one of the children and their birth mother are HIV-positive.
Administrators informed the children’s foster parents that they would not be allowed back to school until they each test negative for HIV and submit the results. Two of the children are in special needs classes, and the Disability Rights Center (DRC) of Arkansas has taken the lead in advocating for all three siblings to return to school.
The DRC released a statement on September 13, which reads in part:

The fact that the foster families have to provide documentation that the children are HIV negative before entering the school is unlawful and immoral. Further, the fact the school’s attorney authorized this unlawful act is at best appalling. It stigmatizes individuals with disabilities or their “perceived†disabilities as there is no indication these individuals have HIV
The Americans with Disabilities Act states the following:

A public school system may not prohibit a child with HIV or AIDS from attending elementary school.
Online, many were shocked by the school’s treatment of the students. The case drew comparisons to Ryan White, a student with AIDS who gained national prominence in 1985 when his school banned him.

HIV can be spread by saliva and blood. It’s a safety issue. Get the kids tested, provide documentation and get over it. Teachers and staff wipe noses and clean up scrapes every day. For their safety they need to know when they need to take extra precautions. It’s too bad people continue to use IV drugs and have unprotected sex and pass HIV on to innocent children.

if one of the students gets into a fight, gets hurt during PE playing basketball or football or just falling down and start bleeding the school staff can treat the student with universal precautions.
