For the past few years, polls from firms like Gallup, Pew and others have shown that a majority of Americans backs the legalization of marijuana, but a new survey released Wednesday finds the highest support yet for ending prohibition.

The poll, conducted by Beyond the Beltway, a collaboration between political consulting firms Benenson Strategy Group and SKDKnickerbocker, finds that 61 percent of U.S. voters favor legalization, with 39 percent opposed. Previously, the high water mark for legalization was 58 percent in a 2013 Gallup poll.

The new survey also finds that 72 percent of Americans support small fines instead of jail time for people caught possessing small amounts of marijuana. Just 28 percent were opposed.

Marijuana Poll Results

Support for marijuana reform crossed party lines in the poll, which found that 68 percent of Republicans and 63 percent of conservatives support replacing jail time for marijuana possession with fines.

People on the right were a little more divided on the question of full legalization, though, with 48 percent of Republicans in support versus 52 percent opposing. However, there is a generational divide that bodes well for future efforts to end marijuana prohibition, with 59 percent of GOP voters under the age of 50 backing legalization compared to 61 percent of Republicans over the age of 50 against.

The poll consists of 1,032 total interviews conducted February 26-27 among registered voters selected from an opt-in online panel to match demographics and other characteristics of the national registered voter population. The margin of error for overall results is ±3.05% and higher among subgroups.
