Judge Strikes Down Florida Welfare Drug Test Law

Happy holidays, indeed! First Uruguayan President Mujica give us a Christmas present by signing his country’s law legalizing marijuana commerce (no surprise there, really), and now, a federal judge throws invites us to welcome the new year with a ruling throwing out Florida Gov. Rick Scott’s (R) welfare drug testing law.

In a ruling out of Orlando today, US District Court Judge Mary Scriven permanently halted enforcement of the law, agreeing with an earlier court finding that "there is nothing inherent in the condition of being impoverished that supports the conclusion that there is a concrete danger that impoverished individuals are prone to drug use…."

The law required anyone applying for welfare benefits to undergo a drug test without any particularized suspicion that he or she was using drugs. The federal courts have been loath to okay suspicionless drug testing, with a few notable exceptions for workers in public safety positions and some school kids.

The case is Lebron v. Florida Department of Children and Families. We’ll have more on it later.

Oh, and the never-say-die Gov. Scott says he will appeal.

  I think the 4th amendment should cover this,
      Only a nut would think the original framers of the Constitution would approve

The main reason this is being struck down (imo) is that people were saying that if welfare ppl get tested, congress should get randoms too.

I’m glad to see this.  Never should have been passed in the first place.

The entire affair was a scam by "Governor" Scott.  It would seem that he was owner of a large chain of the Solantic ‘urgent care’ facilities, who was unsurprisingly the primary beneficiary of this illegitimate testing.

He got this law passed by pandering to the self-righteous’ fear of imbibers, to put the money in his own pocket.  After being challenged, he divested his interest in the company to make it "legal"…the proceeds now go to his fucking WIFE, as if that made it all better somehow.

I can only blame the utterly controlled mass media for keeping the lid from being blown completely the fuck off of this governmental scam.

Motherfucker should be impeached, sued, and all profits returned to the individuals who were strongarmed into submission to this ‘testing’ to their own financial detriment, with interest.  Any family financial assets should be forefitted to the state to recoup the cost to the taxpayers (yes, the state ended up LOSING money on this fraudster gambit), with interest.  Furthermore, he AND HIS WIFE should be prosecuted for fraud, and whatever other charges can be justifiably drummed up, and placed in the corporate penal system so he can get a good taste of the misguided ‘justice’ he’s meted out to the populace (along with regular cornholing and a diet of ‘loaf’!!).
